Marketplace - seller terms & conditions

The OTCdomain Marketplace allows you to sell your domain names, website design, logo design & other services to potential customers. Read more about how it works here. 

These Terms and Conditions apply to You (the seller) and OTCdomain. 

General Terms & Conditions

  • OTCdomain reserves the right to approve or deny your Marketplace submissions.
  • Until the Domain Transfer,  website design, logo design & other services is complete, the customers have the ability to cancel their purchase. In that case, the customer's payment will be refunded and you will not receive any compensation. The domain name,  website design, logo design & other services will be re-listed for sale in the Marketplace. 
  • Your account must be active and in good standing at the time of domain website design, logo design & other services sale in order for you to receive the compensation. 
  • OTCdomain may design Logos or custom images to promote some of your domains website design, logo design & other services in our Marketplace. Any such Logos or custom images are exclusive property of OTCdomain and can not be reproduced or displayed on third party websites without written permission of OTCdomain.

Commission Structure & Pricing

  • For Premium Listings, the typical commission charged by OTCdomain ranges from 15% to 30%, depending upon the final selling price. Check this page for more details on Commissions and other Benefits. 
  • For Standard Listings, sellers pay a fixed commission of 7.5%. Sellers can also opt for additional marketing exposure on Standard listings for increased commission, or a small upfront fee.
  • For Premium Domains, there is a 15% standard commission, however, a custom commission may be set for some ultra premium domains, which will be communicated with the seller upfront. The listing will be published upon acceptance of the commission by the seller.
  • For OTCdomain-Registered Domains, the typical commission offered to sellers is 25% of the selling price (during the first year). OTCdomain covers the cost of domain registration and ongoing renewal fees for OTCdomain-registered domains. However, OTCdomain reserves the right to not renew domains at its discretion.
  • Your final commission will be based upon the actual selling price of the domain. The commission will be deposited to your account after the domain,  website design, logo design & other services has been successfully transferred to the buyer. For example, if the commission rule is OTCdomain Receives 30% and the domain,  website design, logo design & other services sells for $3000, you will receive $2100 Net proceeds after it is transferred to the buyer. 
  • OTCdomain has partnerships with third party agencies and selling platforms to promote and sell your domains,  website design, logo design & other services. If a buyer purchases the domain website design, logo design & other services via these third party platforms, they may incur an additional markup to cover the cost of commission by these platforms.

Domain Transfers

  • Once a domain has been purchased, you agree to transfer the domain promptly to OTCdomain's holding account in the same registrar, or by providing an Authorization Code (in case of a different registrar). OTCdomain team will work with the buyer to assist them in transferring the domain to their ownership.
  • If OTCdomain team is not able to receive transfer instructions from the buyer within 5 business days, you may be asked to transfer the domain to OTCdomain's ownership so that you can receive the payment for the purchase price of the domain (minus any applicable commissions)
  • Once you have received the payment for the purchase price of the domain (minus any applicable commissions), you no longer have any rights to the domain.

OTCdomain Registered Domains - Terms & Conditions

  • OTCdomain allows the ability for sellers to submit unregistered domain ideas and have OTCdomain pay for the domain registration fees as well as ongoing renewals. If your Marketplace submission is accepted, OTCdomain will deduct 100 points from your account. 
  • OTCdomain will register the domain name for your entry and as a result will be the owner of record for that domain name. Therefore, you will no longer have the ability to list that domain for sale in other marketplaces (outside OTCdomain.com platform). 
  • Renewals: OTCdomain will register the domain for a duration of 1 year. At the end of the year, OTCdomain may decide whether or not to renew the domains at its discretion. If the domains are renewed, OTCdomain will continue to pay for the domain renewals in lieu of reduced seller commissions. If you wish to keep the original seller commission, you will have the ability to pay a fee of $10 (or $5 plus 500 points) to keep the current seller commission for another year. Please note that these commission rules can be different for different domains (based upon several factors) and you will be able to see the exact rule before deciding on a renewal option.
  • OTCdomain will not be able to transfer the domain ownership back to you under any circumstance. 
  • OTCdomain has complete control & discretion over setting a selling price and discounts for OTCdomain owned domains. Based upon market factors, OTCdomain may decide to increase or decrease the price of these domains at any time.

Seller Owned Domains Terms & Conditions (Premium Listings)

  • If your listing is approved, you would need to point your domains to the OTCdomain Name Servers (i.e. these domains will be listed exclusively on OTCdomain)
  • In case of Seller-owned domains, you have the option to submit domains with or without OTCdomain credits. You receive additional benefits with OTCdomain credits such as faster review times, partial exclusivity, and better commission rates. However, if your domains are not approved, the credits are not refundable.
  • In case of Seller-owned domains, OTCdomain has limited control over lowering the selling price or offering a discount once the listing has been approved by the seller. OTCdomain will not reduce the approved selling price by more than $200 (unless that reduction is explicitly approved by the seller). 
  • You can remove your listing at any time by giving us a 30-day notice
  • If the domain received an offer or inquiry within the last 30 days, you must wait 30 days before requesting a removal of the listing.
  • Excessive or Frequent removal of listings will likely reduce your ability to submit domains in the future because OTCdomain makes upfront investment in creating logos and promoting the domains.
  • OTCdomain may notify you regarding any offers or inquiries received on the domain. You are under no obligation to accept an offer below the BIN price. Raising the BIN price immediately after an inquiry or offer is received is not allowed. If you raise the BIN price within 7 days of receiving an inquiry or offer, you must notify the OTCdomain team and provide at least a 72-hour window to allow the buyer to complete the purchase at the original BIN price.
  • If you remove the listing, you do not own any rights to the logo created by the OTCdomain team.
  • Selling any of your premium listings outside OTCdomain platform while your listing is active at OTCdomain is a direct violation of our Terms of Service. 

Seller Owned Domains Terms & Conditions (Standard Listings)

  • You are not required to point your Standard Listings to OTCdomain Name Servers but you must verify the ownership of the domains (either by adding Name Servers or TXT records)
  • You have full flexibility in setting pricing for Standard Listings
  • Standard Listings do not require any exclusivity. You are allowed to list Standard Listings on any other platforms
  • Negotiating with a buyer on OTCdomain platform and completing the sale outside OTCdomain is not allowed. If the Transaction requires the use of a third party Escrow service, OTCdomain can assist with setting up such a transaction
  • If you no longer own the Standard Listing, or if it sells outside OTCdomain platform, you must delist the domain from your OTCdomain account to ensure it is no longer offered for sale.

Seller owned website design, logo design & other services Terms & Conditions (Premium Listings)

  • If your listing is approved, you agree these website design, logo design & other services will be listed exclusively on OTCdomain
  • You have the option to submit website design, logo design & other services with or without OTCdomain credit. You receive additional benefits with OTCdomain credit such as faster review times, partial exclusivity, and better commission rates. However, if your domains are not approved, the credits are not refundable.
  • OTCdomain has limited control over lowering the selling price or offering a discount once the listing has been approved. OTCdomain will not reduce the approved selling price by more than $200 (unless that reduction is explicitly approved). 
  • You can remove your listing at any time by giving us a 30-day notice
  • If the website design, logo design & other services received an offer or inquiry within the last 30 days, you must wait 30 days before requesting a removal of the listing.
  • Excessive or Frequent removal of listings will likely reduce your ability to submit website design, logo design & other services in the future because OTCdomain makes upfront investment in creating logos and promoting the website design, logo designs & other services.
  • OTCdomain may notify you regarding any offers or inquiries received on the website design, logo design & other services. You are under no obligation to accept an offer below the BIN price. Raising the BIN price immediately after an inquiry or offer is received is not allowed. If you raise the BIN price within 7 days of receiving an inquiry or offer, you must notify the OTCdomain team and provide at least a 72-hour window to allow the buyer to complete the purchase at the original BIN price.
  • If you remove the listing, you do not own any rights to the logo created by the OTCdomain team.
  • Selling any of your premium listings outside OTCdomain platform while your listing is active at OTCdomain is a direct violation of our Terms of Service. 

Seller owned website design, logo design & other services Terms & Conditions (Standard Listings)

  • You have full flexibility in setting pricing for Standard Listings
  • Standard Listings do not require any exclusivity. You are allowed to list Standard Listings on any other platforms
  • Negotiating with a buyer on OTCdomain platform and completing the sale outside OTCdomain is not allowed. If the Transaction requires the use of a third party Escrow service, OTCdomain can assist with setting up such a transaction
  • If you no longer own the Standard Listing, or if it sells outside OTCdomain platform, you must delist the listing from your OTCdomain Seller account to ensure it is no longer offered for sale.
